This agreement applies when we, RGB Solutions trading as Impact Persona [ABN: 56 762 463 213] supply our products, services and information to you, our customer or end user. Additional Terms & Conditions from our third party information providers or payment gateways may also apply. These may include but are not limited to PayPal Australia and Braintree Payments. Please review their respective Terms, Conditions and Privacy policies accordingly.
Interpretation:
“We”, “Us” and “Impact Persona” means RGB Solutions and its subsidiaries
“Customer”, “the customer” or “you” means the individual or company purchasing our products or services
“Intended recipient” or “end user” means the individual for whom our products or services were purchased for and or on behalf of
“Content” means any digital file or communication provided by Impact Persona to you, or an end user
“Sale Price” means the price at which our products and services are normally supplied excluding any discount obtained at the time of purchase itself
Use of Impact Persona Products & Services:
You are permitted to use our service for both personal and business use providing that you understand and agree that;
You, or the intended recipient does not modify, copy, reproduce, republish, frame or transmit to a third party or distribute any content provided by Impact Persona in any way except as originally provided to you with the exception of clause (2)
You, or the intended recipient, is permitted, to republish, print or transmit if full, without change or variance, our products as they relate to you, the end user, and only to you, for the explicit purpose of seeking employment, promotion or employment advantage, with any entity unrelated or closely related to yourself, and on the condition that the individual or company in question likewise adheres to this, our Terms, Conditions and Privacy policy
You, or the intended recipient does not resell, beyond the Sale Price to any third party, person or company, the products or services we provide without our express written consent
You recognise that Impact Persona, nor its trustees, beneficiaries, or employees are permitted to provide legal, personal or professional advice, regarding the specifics of any given report, product or service, nor can they be expected to interpret the data contained within it as it relates to the individual in question and that where any such advice may be supplied, implied or otherwise, this advice is general in nature
All transactions are final at the time of "Check Out" and payment is non refundable with the exception of situations whereby the transaction fails to successfully complete for any reason, and or the end user has been unable to complete their DISC assessment for technical reasons outside of their control
No refunds, cancellations or credit will be provided whilst a transaction is being processed, pending or in any state other than completed unless the transaction has failed for reasons beyond your control or that of the end user
In the event payment is made by PayPal or another provider using an account which does not allow for the immediate transfer of funds, including but not limited to, eCheque accounts, reports will not be generated until such time as your payment clears the nominated account. Please be aware this can take between one (1) and seven (7) days but may vary depending on the account selected by you, the customer
Limited Liability & Indemnity
The customer agrees that our liability is limited to refunding the fee paid by the customer or end user for products or services provided.
You, the customer and on behalf of the end user, agrees to indemnify RGB Solutions, trading as Impact Persona, its employees, trustees, directors and beneficiaries and to continue keeping us indemnified, against all claims and damages, loss, actions, proceedings, all costs (including legal fees) arising from your reliance on any of the information obtained from our website; your access to our website or information contained within any of products or services provided by us.
To the extent permitted by law, we shall not be held liable for any direct, indirect or implied loss, damage or expense suffered by the customer or end user, howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the products or services. We shall not be liable under any circumstance to the customer, end user or third party for any indirect or consequential loss of profit or other economic loss suffered by the customer or end user howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.
Force Majeure
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery and the party shall be entitled to a reasonable extension of its obligations.

every effort is made to store and protect what we believe to be personal, private or otherwise identifiable information about you, the customer or end user, including but not limited to your or that of the end users, Name and Email address
We, RGB Solutions, trading as Impact Persona, nor its employees shall contact an end user without the express consent of the customer of our products or services in accordance with these, our Terms and Conditions
